57th GST Council meeting: what changes for you

Key recommendations from yesterday's meeting at Bharat Mandapam, New Delhi, chaired by the Finance Minister. Most need law amendments or notifications before they apply.

  1. Notices

    No notice below ₹10,000

No show cause notice where tax involved is under ₹10,000. Pending notices and appeals below this limit to be dropped.

  2. Penalties

    General penalty cut to ₹10,000

Section 125 penalty reduced from ₹25,000. Only 5% penalty in non-fraud cases if tax and interest are paid within 30/60 days of the order.

  3. Prosecution

    Arrest power removed

Section 69 arrest power to be omitted. Prosecution threshold raised from ₹1 crore to ₹5 crore.

  4. Refunds

90% refund in 3 working days

Risk-based automatic sanction of 90% for export and inverted-duty refunds. Acknowledgement time cut from 15 to 10 days. Excess cash ledger refunded automatically.

  5. Inverted duty

Refund on input services and machinery

ITC on input services refundable from 1 Nov 2026; on capital goods from 1 Apr 2027, spread over 60 months.

  6. ITC

    More credits unblocked

Employee health and life insurance, outdoor catering, telecom towers, pipelines outside the factory, free samples and goods destroyed on expiry.

  7. Registration

    Auto-approved amendments

Changes like trade name, partners/directors and additional places of business accepted automatically. Cancellation to be automated in phases.

  8. Small business

Annual return option up to ₹5 crore

In-principle approval for B2C taxpayers with turnover up to ₹5 crore to file once a year and pay tax quarterly. Late fee relief if filed by month-end.

  9. E-way bill

    Fewer roadside stoppages

Vehicles stopped only on specific intelligence with Joint Commissioner approval, and only by the origin or destination state.

  10. Rates

    No change in GST rates

Rate changes now to be taken up once a year in a separate meeting. E-commerce delivery services: 5% without ITC.
